LEGAL GROUNDS AND PURPOSES OF PERSONAL DATA PROCESSING Your data is processed for the following purposes and on the following grounds:
For the purpose of undertaking activities that lead to the conclusion of a contract (such as responding to queries regarding potential cooperation, preparation of cooperation offers) – on the grounds of article 6 section 1 letter b of the general data processing regulation no. 2016/679 („Regulation”) (i.e. processing is necessary to undertake activities at your request, prior to entering into a contract to which you are party);
For the purpose of performing a contract and undertaking activities tied to the concluded contract, that is the Data Controller providing you with legal services (such as legal counseling on a day-to-day basis, providing legal advice and legal consultations, preparing legal opinions, drafting legal acts, appearing in public authority offices and courts) or you providing the Data Controller with services, or undertaking any other professional cooperation (related to the business activities exercised by the Data Controller) – on the grounds of article 6 section 1 letter b of the Regulation (i.e. processing is necessary for the performance of a contract to which the you are party);
For the purpose of complying with legal obligations, such as the payment of taxes deriving from an executed contract – on the grounds of article 6 section 1 letter c of the Regulation (i.e. processing is necessary for compliance with the Data Controller's legal obligation);
For the purpose of providing legal advice and undertaking relevant activities (such as processing personal data of the clients' or collaborators' employees or colleagues, or other persons whose personal data is processed by the Data Controller in the scope of his business activity, including court proceedings) – on the grounds of article 6 section 1 letter f of the Regulation (i.e. processing is necessary for the purposes of the legitimate interests of the Data Controller);
For the purpose of undertaking marketing activities, including sharing (for example through electronic communications) newsletters (only if you express your consent) – on the grounds of article 6 section 1 letter a of the Regulation (i.e., your consent).
PERSONAL DATA PROCESSING PERIOD The personal data shared by you will be stored for a time that is necessary to undertake the activities listed in section 2 hereinabove, or until you withdraw your consent (if applicable). The period of personal data processing may be extended each time by the period of limitation on the validity of claims, if the processing of personal data is necessary for the Administrator to pursue or defend against any such claims. After this period, the data will be processed only to the extent and for the time required by law.
NO OBLIGATION TO SHARE PERSONAL DATA You are not obliged to share the above-mentioned data. Sharing such data is not a legal or contractual requirement. Your refusal to share data might result in the impossibility of undertaking activities as set out in section 2 hereinabove.
PERSONAL DATA RECIPIENTS Your personal data may be shared with entities providing the Data Controller with services that are tied to our collaboration, such as accounting services, legal services (such as tax and debt collection services), services tied to the flow of correspondence (such as correspondence registration, postal operators, couriers, document archiving), IT services (such as information technology system providers and daily maintenance), payment services (such as banks). In addition the data may be shared with other entities with which the Data Controller collaborates, including subcontractors and other providers and contractors, in particular legal counsels and advocates cooperating with the Data Controller, accounting offices, tax offices, notaries and bailiffs. Personal data may be transferred to authorized courts and public authorities in the scope necessary for compliance with existing provisions of law.
ADDITIONAL INFORMATION The Data Controller did not elect a data protection officer. The Data Controller does not use automated decision-making processes, including profiling. The personal data is not being transferred to third countries or international organizations.
RIGHTS You have the right:
to withdraw your consent at any moment (though this does not affect the lawfulness of the processing of personal data that was effected before the consent was withdrawn and the lawfulness of personal data processing on other grounds than of consent);
to object to the processing of your personal data;
to demand access, rectification or the erasure of your personal data, as well as the restriction of the processing of your personal data and its transfer;
th lodge a complaint with the supervisory authority, that is the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych) if you decide that the processing of your personal data is in breach of the Regulation.
